Terms of Service

1. Service Description

HelloClaw ("the Service") provides managed hosting of OpenClaw, an open-source AI agent, on behalf of its customers ("you"). The Service includes infrastructure management, AI model access, and messaging platform integration.

2. Account and Subscription

You must maintain an active subscription to use the Service. Your subscription covers the hosting infrastructure. AI usage credits are purchased separately and consumed based on your AI model usage.

3. AI Usage and Credits

AI credits are consumed when your assistant processes messages using AI models (OpenAI, Anthropic, etc.). Credit costs vary by model. Purchased credits are non-refundable. When your credit balance reaches zero, AI-powered features will be temporarily unavailable until you purchase more credits. Your assistant will continue running for non-AI tasks.

4. Data and Privacy

4.1 Your Data

Your assistant stores conversation history, memory, preferences, and configuration data. This data is stored on isolated, encrypted storage dedicated to your account. We do not access, read, sell, or share your data with any third party for any purpose.

4.2 AI Model Providers

Messages processed by your assistant are sent to third-party AI model providers (such as OpenAI and Anthropic) for processing. These providers have their own data handling policies. We proxy these requests on your behalf and do not retain copies of the data sent to or received from these providers beyond what is stored in your assistant's conversation history.

4.3 Messaging Platforms

When you connect WhatsApp, Telegram, or other messaging platforms, your messages flow through those platforms' infrastructure. We do not control how these platforms handle your data.

5. Security

We implement reasonable security measures including: network isolation between customer instances, encrypted storage, centralized API key management (you never handle raw API keys), and hardened OpenClaw configuration with restricted permissions.

6. Limitation of Liability

6.1 OpenClaw Software

OpenClaw is open-source software developed by third parties. While we apply security hardening and keep the software updated, we cannot guarantee it is free from vulnerabilities. OpenClaw's creator has stated that it "requires careful configuration to be secure" and "is not meant for non-technical users." We mitigate these risks through our managed configuration but cannot eliminate them entirely.

6.2 Third-Party Services

The Service depends on third-party infrastructure and services including Amazon Web Services (AWS), OpenAI, Anthropic, WhatsApp, and Telegram. We are not liable for outages, data loss, or security incidents caused by these third-party services.

6.3 Data Loss

We are not liable for any data loss, data exposure, or data corruption that occurs due to: (a) bugs or vulnerabilities in the OpenClaw software, (b) failures or breaches of AWS infrastructure, (c) failures or breaches of AI model providers, (d) failures or breaches of messaging platforms, (e) prompt injection attacks or other AI-specific attack vectors, or (f) any other cause beyond our reasonable control. We commit to never intentionally access, resell, or misuse your data, and to implement commercially reasonable security measures.

6.4 No Warranty

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

7. Acceptable Use

You may not use the Service for illegal activities, harassment, spam, or any purpose that violates the terms of service of the underlying AI model providers or messaging platforms. We reserve the right to suspend accounts that violate this policy.

8. Account Termination and Data Retention

Upon cancellation of your subscription, your assistant will be suspended. Your data will be retained for 30 days, during which you may export it. After 30 days, your data will be permanently deleted.

9. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email. Continued use of the Service after changes take effect constitutes acceptance of the new terms.
